These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you," "your," or "Guest") and The Little Play Avenue, LLC ("TLPA," "we," "us," or "our"), an Arizona limited liability company located at 13802 N 32nd St, Suites 1, 2, & 3, Phoenix, AZ 85032. By accessing or using our facility, website (thelittleplayavenue.com), booking system, classes, events, café, retail offerings, or any related services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.
If you are entering, booking, or registering on behalf of a minor child (under 18 years of age), you represent and warrant that you are the child's parent, legal guardian, or authorized caregiver with full authority to bind yourself and the child to these Terms. You accept full responsibility for the child's compliance with these Terms and for any consequences arising from the child's use of our Services.
If you do not agree with any provision of these Terms, you must refrain from using our Services. We reserve the right to modify these Terms at any time by posting the revised version on our website. Continued use of any Service after such modification constitutes acceptance of the updated Terms.
Age and Eligibility. The Little Play Avenue is designed for children ages 0 through 7 years. Children outside this age range may be restricted from certain play areas or activities at the sole discretion of TLPA staff. All children must be accompanied by a parent, legal guardian, or authorized caregiver (at least 18 years of age) at all times while on the premises. TLPA staff members facilitate programming and monitor general facility safety but are not responsible for the direct, individual supervision of your child.
Health and Safety. For the health and safety of all guests, we ask that you do not bring your child to TLPA if they are exhibiting symptoms of illness, including but not limited to fever, vomiting, diarrhea, persistent cough, rash, or any symptoms of a communicable disease, within the preceding 24 hours. TLPA reserves the right to refuse entry or require the immediate departure of any guest who, in our reasonable judgment, poses a health risk to others.
Attire and Hygiene. All guests must wear socks while in designated play areas. TLPA branded socks are available for purchase at the front desk. Children who are not yet toilet-trained must wear a diaper or pull-up at all times. Adults must remove shoes before entering play zones. Guests are expected to practice good hygiene, including hand-washing upon entry and after using restrooms.
Prohibited Items and Activities. The following are not permitted on TLPA premises: outside food or beverages (except documented allergy-related items, infant formula, and breast milk); chewing gum; weapons of any kind; drugs or alcohol; pets (except certified service animals with proper documentation); personal play equipment, balls, or toys that may interfere with facility operations. Running in non-play areas, climbing on furniture not designated for play, and roughhousing are not permitted. TLPA reserves the right to confiscate prohibited items and to remove guests who violate these rules without refund.
Allergies. TLPA's café and event spaces may contain or serve items with common allergens, including but not limited to tree nuts, peanuts, dairy, eggs, wheat, soy, and shellfish. It is the sole responsibility of the parent, guardian, or caregiver to identify and manage their child's allergies and dietary restrictions. While we make reasonable efforts to maintain a safe environment, TLPA does not guarantee an allergen-free facility and shall not be held liable for allergic reactions that occur on the premises.
Reservations. Open play sessions, classes, camps, and other programming may be reserved through our online booking platform (powered by iClassPro) or at the front desk, subject to availability. A reservation is confirmed only upon receipt of full payment or a valid deposit, as applicable. By making a reservation, you agree to the specific terms associated with that booking type, including session times, capacity limits, and age requirements.
Pricing. All prices for Services are listed on our website and at our facility and are quoted in U.S. dollars. TLPA reserves the right to adjust pricing at any time without prior notice; however, confirmed reservations will be honored at the price in effect at the time of booking.
Payment Methods. We accept major credit cards, debit cards, and such other payment methods as may be listed on our website or at the front desk. All payment transactions are processed through secure, PCI-compliant third-party payment processors. TLPA does not store full credit card numbers or CVV codes on its own systems.
Memberships and Passes. Memberships and multi-visit passes are subject to their own specific terms, which are provided at the time of purchase. Memberships are non-transferable unless otherwise stated. TLPA reserves the right to modify membership benefits, pricing, or structure with thirty (30) days' written notice to current members. Membership cancellation requests must be submitted in writing at least fifteen (15) days prior to the next billing date.
Cancellations and Refunds. Cancellations for open play sessions must be made at least 24 hours prior to the scheduled session start time for a full refund or credit. Cancellations for classes and camps must be made at least 72 hours before the first scheduled session. No-shows and late cancellations are non-refundable. TLPA may cancel or reschedule any session, class, or event due to insufficient enrollment, weather, staffing, or other operational reasons. In such cases, registered guests will receive a full refund or credit at their election. All refund requests should be directed to [email protected].
Booking and Deposits. Birthday parties and private events require a non-refundable deposit at the time of booking to secure your date and time. The remaining balance is due no later than seven (7) days prior to the event date, unless otherwise specified in your event agreement. Failure to pay the remaining balance by the deadline may result in cancellation and forfeiture of the deposit.
Event Modifications and Cancellations. Date changes are accommodated subject to availability and must be requested at least fourteen (14) days before the original event date. Cancellations made fourteen (14) or more days before the event will forfeit the deposit only. Cancellations made fewer than fourteen (14) days before the event will forfeit the full event balance. TLPA reserves the right to cancel an event due to force majeure (including but not limited to natural disasters, government orders, pandemics, or facility emergencies), in which case a full refund, including the deposit, will be issued.
Guest Count and Capacity. Final guest counts must be confirmed at least seven (7) days before the event. Additional guests beyond the confirmed count may be accommodated at the then-current per-head rate, subject to capacity. Maximum occupancy limits are enforced for safety and fire code compliance and may not be exceeded under any circumstances.
Decorations and Outside Vendors. All decorations, themes, and setup arrangements must be pre-approved by TLPA. No glitter, confetti, piñatas, open flames, or adhesives (tape, nails, tacks) that may damage surfaces are permitted. Outside food vendors are not permitted unless expressly authorized in writing by TLPA management. The event host is responsible for ensuring that all guests comply with facility rules.
Cleanup and Damages. Basic cleanup is included in the event fee. Excessive mess or damage to the facility, equipment, or furnishings will be assessed and billed to the event host at replacement or repair cost, plus a reasonable administrative fee.
Assumption of Risk. You acknowledge and understand that participation in indoor play activities, classes, camps, and events at TLPA involves inherent risks of physical injury to both children and adults, including but not limited to falls, collisions, sprains, fractures, head injuries, soft-tissue injuries, and exposure to communicable illnesses. These risks exist regardless of the care taken by TLPA to maintain a safe environment. By entering our facility and using our Services, you voluntarily assume all such risks, both known and unknown, on behalf of yourself and any minor child in your care.
Waiver and Release of Liability. To the fullest extent permitted by law, you, on behalf of yourself and any minor child in your care, hereby release, waive, discharge, and covenant not to sue The Little Play Avenue, LLC, its owners, members, managers, officers, employees, agents, contractors, and volunteers (collectively, "Released Parties") from any and all liability, claims, demands, causes of action, and damages of any kind arising out of or in any way related to your or your child's use of our facility, equipment, programs, services, or café offerings, including but not limited to claims based on negligence of the Released Parties. This release does not apply to claims arising from the gross negligence or willful misconduct of the Released Parties.
Indemnification. You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your or your child's use of our facility or Services; (b) your breach of these Terms; (c) any injury or damage caused by you or your child to another guest, staff member, or third party; or (d) any violation of applicable law or regulation by you or your child.
Limitation of Liability. To the maximum extent permitted by applicable law, in no event shall TLPA's total aggregate liability to you for all claims arising out of or related to these Terms or your use of our Services exceed the total amount you paid to TLPA for the specific Service giving rise to the claim in the twelve (12) months preceding the event. In no event shall TLPA be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of income, emotional distress, or loss of enjoyment, regardless of the theory of liability.
Medical Authorization. In the event of an injury, illness, or medical emergency involving you or your child while at TLPA, you authorize TLPA staff to contact emergency medical services (911) and to provide basic first aid as reasonably necessary. You understand that TLPA staff are not licensed medical providers. You are solely responsible for any medical expenses incurred as a result of treatment administered to you or your child.
Respectful Environment. TLPA is committed to maintaining a welcoming, inclusive, and family-friendly environment for all guests, staff, and community members. We do not tolerate discrimination, harassment, bullying, or abusive behavior of any kind, whether directed at children, adults, or staff. All guests are expected to treat others with kindness, patience, and respect at all times.
Supervision Responsibilities. Parents, guardians, and caregivers are solely responsible for the behavior and supervision of the children in their care. This includes ensuring that children use equipment appropriately, follow staff instructions, and interact respectfully with other children and adults. TLPA staff may redirect children who are not following rules; however, disciplinary decisions remain the responsibility of the accompanying adult.
Photography and Recording. Personal photography and video of your own child for private, non-commercial use is permitted. You may not photograph, video, or record other people's children without their parent or guardian's explicit consent. TLPA may capture photographs or video during regular operations, classes, events, and celebrations for use on our website, social media, or marketing materials, subject to our Photography Consent Policy as described in our Privacy Policy.
Right to Remove. TLPA reserves the right, in its sole discretion, to deny entry to or remove any guest from the premises who violates these Terms, facility rules, or standards of conduct, or who poses a safety risk to themselves or others. No refund will be issued in the event of removal for cause.
Ownership. All content, materials, designs, logos, trademarks, trade names, graphics, photographs, text, software, and other intellectual property displayed on our website, social media channels, marketing materials, and within our facility (collectively, "TLPA Content") are the exclusive property of The Little Play Avenue, LLC or its licensors and are protected by applicable copyright, trademark, and intellectual property laws.
Restrictions. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, or otherwise exploit any TLPA Content without our prior written consent, except for incidental personal, non-commercial use (such as sharing a single social media post that tags or credits TLPA). Unauthorized use of any TLPA Content may violate copyright, trademark, and other applicable laws and could result in civil or criminal penalties.
User-Generated Content. By posting reviews, testimonials, photographs, or other content that mentions or tags TLPA on social media or other platforms ("User Content"), you grant TLPA a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable license to use, reproduce, modify, adapt, publish, and display such User Content in connection with our business and marketing, with attribution where practicable.
Governing Law and Jurisdiction. These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict-of-law principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you irrevocably consent to the personal jurisdiction and venue of such courts.
Dispute Resolution. Prior to initiating any formal legal proceeding, you agree to first attempt to resolve any dispute with TLPA through good-faith informal negotiation by contacting us at [email protected]. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue mediation administered by a mutually agreed-upon mediator in Maricopa County, Arizona, before pursuing litigation.
Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity of any provision shall not affect the validity or enforceability of the remaining provisions.
Waiver. The failure of TLPA to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of TLPA.
Entire Agreement. These Terms, together with our Privacy Policy and any additional agreements executed in connection with specific Services (including event contracts and membership agreements), constitute the entire agreement between you and TLPA with respect to the subject matter hereof and supersede all prior or contemporaneous oral or written communications, proposals, and representations.
Force Majeure. TLPA shall not be liable for any failure or delay in performance of its obligations under these Terms resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, government orders or restrictions, war, terrorism, labor disputes, power failures, internet or telecommunications failures, or supplier failures.
Accessibility. TLPA is committed to making our facility and digital properties accessible to all guests, including those with disabilities. If you require an accommodation or have questions about accessibility, please contact us and we will make reasonable efforts to assist you.
